Public offer
Darwin Evolution Lviv LLC (hereinafter — the Club) offers individuals (hereinafter — the Client) to receive Club services under the terms of this Public Offer.
Placing a booking and paying for it in full or in part means that the Client has read the terms of this Public Offer and agrees with them.
1. Club services
The Club provides services for organizing and conducting shooting training sessions, use of shooting galleries, instructor services, use of Club firearms, and other related services.
The specific composition of a service, its duration, number of shots, type of firearm, need for a personal instructor and its cost are determined by the package chosen by the Client or the Club’s current price list.
The Club may change the list of services and prices. The price agreed at the time of booking applies to a booking that has already been paid for.
2. Booking and conclusion of the agreement
You can book services via the Club’s website, by phone, via messengers, social networks, or directly at the Club.
A booking is considered confirmed after the Club has agreed the date and time and, where required by the booking terms, prepayment has been made.
Payment or prepayment for a booking constitutes the Client’s full and unconditional acceptance of the terms of this Public Offer.
Before shooting, each participant is required to complete a safety briefing and follow the Club’s rules.
3. Price and payment
The cost of services is determined by the Club’s current price list and/or the price of the package chosen by the Client.
Payment may be made in cash, by bank card, by bank transfer, or by another method available at the Club or on its website.
Additional shots, additional time, additional firearms, personal instructor services and other services not included in the chosen package are paid for separately according to the Club’s current price list.
4. Safety and the Club’s right to refuse admission
The Club’s services involve the use of firearms and require unconditional compliance with safety rules.
The safety of Clients, employees and other people takes priority over conducting or continuing a training session.
The Club may refuse to admit a Client to shooting, not start or at any time terminate a session if the instructor has reasonable doubts about the possibility of conducting it safely.
Grounds for such a decision may include, in particular:
- signs of alcohol, drug or other intoxication;
- excited, aggressive or other condition of the Client that may affect safe handling of firearms;
- inability or unwillingness to follow the instructor’s commands;
- unsafe handling of firearms;
- a single gross or repeated violation of safety rules;
- actions or behavior that pose a threat to the Client, Club employees or other people;
- any other circumstances that give the instructor reasonable grounds to doubt the possibility of conducting the session safely.
The Client is required to immediately comply with the instructor’s command to stop shooting, unload or put down the firearm, and other safety-related commands.
The final decision on admission to shooting and on continuing or terminating a session on safety grounds is made by the Club’s authorized instructor.
5. Safety rules during shooting
Persons who have completed the mandatory briefing and received permission from a Club instructor are admitted to shooting.
While in the shooting gallery, the Client is required to follow safety rules and comply with the instructor’s commands.
Without the instructor’s permission, it is prohibited to:
- load or unload a firearm;
- point a firearm outside the permitted direction;
- leave the shooting position with a firearm;
- hand a firearm to another person;
- touch a firearm after a cease-fire command;
- perform any other actions that may pose a threat to life or health.
Safety-related commands from the instructor are mandatory and must be followed immediately.
6. Instructors
During shooting the Club provides the necessary supervision of compliance with safety rules.
A safety instructor supervises compliance with the rules of safe handling of firearms. Safety instructor service does not include personal training in shooting technique.
A personal instructor provides individual training and helps the Client with firearm handling technique, body position, grip, aiming and other elements of shooting.
If the Client does not have sufficient experience in safe firearm handling, the Club may determine that a personal instructor is required.
The Club’s instructor makes the decision on whether a specific session can be conducted safely.
7. Cancellation and rescheduling
The Client may cancel or reschedule a booking by notifying the Club no later than 24 hours before the start of the booked time.
In case of cancellation less than 24 hours in advance, no-show, or cancellation after the booked time has started, refunds are made taking into account the Club’s actually incurred costs, the reserved time, and the requirements of Ukrainian law.
If the Club is unable to provide a service due to its own fault, the Client is offered to reschedule the booking to another date or to receive a refund for the service not rendered.
8. Lateness
The Client is advised to arrive at the Club 10–15 minutes before the booked time in order to check in and complete the briefing.
If the Client is late, the training time may be shortened by the duration of the lateness if another booking is scheduled to follow.
If time allows, the Club may extend the session to its full scheduled duration.
9. Minors
Admission of minors to training sessions is carried out in accordance with the requirements of Ukrainian law and the Club’s rules.
The Club may require the presence of one of the parents or a legal representative and/or the written consent of one of the parents or a legal representative.
The instructor determines whether a particular type of firearm can be used safely by a minor participant.
For safety reasons, the Club may restrict the available types of firearms, number of shots, exercises, or session format.
10. Firearms and ammunition
Club firearms are used exclusively on Club premises, in designated areas, and in accordance with the instructor’s commands.
If a particular firearm is temporarily unavailable due to maintenance, repair, or other objective reasons, the Club may offer an equivalent replacement.
Ammunition is paid for according to the chosen package or the actual number of rounds used at the Club’s current prices.
Use of the Client’s own firearms and/or ammunition is allowed only with prior agreement of the Club and subject to compliance with the requirements of Ukrainian law and the Club’s rules.
11. Gift certificates
A gift certificate entitles its holder to receive Club services within the face value or the list of services specified on the certificate.
The certificate’s validity period is specified directly on the certificate.
After the validity period expires, the certificate is considered invalid. Unused face value or unused services are cancelled and are not transferred to another period.
Amounts paid to purchase a gift certificate are non-refundable, except where such refund is expressly required by Ukrainian law.
The certificate cannot be exchanged for cash.
If the cost of the chosen services exceeds the face value of the certificate, the certificate holder may pay the difference according to the Club’s current price list.
12. Rights and obligations of the Club
The Club undertakes to:
- provide the services paid for by the Client in accordance with the agreed terms;
- provide the necessary briefing;
- supervise compliance with safety rules;
- keep Club firearms and equipment in proper technical condition;
- provide the Client with accurate information about services and their cost;
- comply with the requirements of Ukrainian law.
The Club may change the way a session is conducted or offer an alternative service if this is necessary for safety reasons or because it is technically impossible to provide the chosen service.
13. Rights and obligations of the Client
The Client is entitled to receive the paid services in accordance with the agreed terms and to receive information about their cost and the procedure for their provision.
The Client undertakes to:
- provide accurate information necessary for the provision of services;
- complete the mandatory briefing;
- follow the safety rules;
- comply with the instructor’s commands;
- treat Club firearms, equipment and other property with care;
- not create a threat to the life or health of other people.
14. Liability
The Club and the Client bear liability in accordance with this Public Offer and Ukrainian law.
The Client is liable for damage caused to Club property or to third parties as a result of intentional acts, negligence, violation of safety rules or failure to follow the instructor’s commands, in the cases and to the extent provided by Ukrainian law.
The Club is not liable for the consequences of the Client’s violation of safety rules or failure to follow the instructor’s lawful requirements and commands, if such consequences were not caused by acts or omissions of the Club.
No provision of this Public Offer limits the Club’s liability in cases where such liability cannot be limited under Ukrainian law.
15. Photo and video
Photo and video by the Client is allowed in places permitted by the Club, provided that it does not create danger and does not interfere with training sessions.
The Club may conduct video surveillance on its premises for the purpose of ensuring safety, protecting visitors, employees and Club property in accordance with Ukrainian law.
The use of a Client’s image in advertising, informational materials, or on the Club’s social networks is carried out on an appropriate legal basis and, in cases provided for by law, with the Client’s consent.
16. Personal data
When booking and providing services, the Club may collect the Client’s name, phone number, email address and other data necessary for the provision of services.
Personal data is processed for the purposes of arranging and fulfilling bookings, making settlements, communicating with the Client, complying with legal requirements and other legitimate purposes.

17. Force majeure and safety restrictions
The Club is not liable for the impossibility or delay in providing services caused by circumstances beyond its reasonable control, including military actions, air raid alerts, accidents, power outages, decisions of public authorities and other extraordinary circumstances.
In the event of such circumstances, the Club may suspend a session or change the way it is conducted in accordance with safety requirements.
With respect to any part of the paid service that has not been provided, the Club offers to reschedule the booking or another method of settlement in accordance with the circumstances and the requirements of Ukrainian law.
18. Dispute resolution
In case of claims, the Client may contact the Club administration by phone, email, or directly at the Club.
The Club and the Client will endeavor to settle the dispute through negotiations.
If agreement cannot be reached, the dispute is resolved in accordance with Ukrainian law.
19. Validity and amendments to the offer
This Public Offer is effective from the date of its publication on the Club’s website.
The Club may amend the Public Offer by publishing a new version.
The version of the offer and the agreed terms in force at the time of concluding the relevant agreement apply to a specific booking, unless otherwise established by Ukrainian law.
The current version of the Public Offer is published on the Club’s website.
